The procedure for trademark extension
In accordance with paragraph 1 of Art. 15 of the Law "On Trademarks, Service Marks and Appellations of Origin" (hereinafter referred to as the Law), trademark registration is valid for ten years from the date of filing of the application.
In accordance with paragraph 2 of Art. 15 of the Law, the validity of a trademark registration is renewed every time for ten years at the request of the owner filed during the last year of its validity.
The application is submitted in Kazakh or Russian.
The application is signed by the owner (copyright holder) or representative acting on the basis of a power of attorney.
The application is accompanied by:
1) a document confirming payment for the renewal of the registration of a trademark, a well-known trademark;
2) a power of attorney (if the application is submitted by a representative) or copies of a power of attorney (if the application is filed by a patent attorney).
The application and the documents attached to it are submitted directly to the expert organization, sent by mail or to the company’s email address.
It is also necessary to pay for the renewal of the registration in accordance with the "Prices for work and services sold by the RSE" NIIP "of the Ministry of Justice of the Republic of Kazakhstan. The fee for extending the validity of a trademark registration to three classes is 27,200.32 tenge; when extending the validity of a trademark, where the list of classes of MKTU is more than three, an additional amount of 13,900.32 tenge must be paid for each class of more than three.
In accordance with paragraph 3 of Art. 15 of the Law, the deadline for filing an application can be restored at the request of the owner, filed within six months after the expiration of the registration.
If the application for extension of the validity period is submitted within six months after the expiration of the validity period of registration, payment must be made for the restoration of the missed period in the amount of 32,269.44 tenge.
