The procedure for trademark extension
In accordance with paragraph 1 of Art. 15 of the Law "On Trademarks, Service Marks and Appellations of Origin" (hereinafter referred to as the Law), trademark registration is valid for ten years from the date of filing of the application.
In accordance with paragraph 2 of Art. 15 of the Law, the validity of a trademark registration is renewed every time for ten years at the request of the owner filed during the last year of its validity.
The application is submitted in Kazakh or Russian.
The application is signed by the owner (copyright holder) or representative acting on the basis of a power of attorney.
The application is accompanied by:
1) a document confirming payment for the renewal of the registration of a trademark, a well-known trademark;
2) a power of attorney (if the application is submitted by a representative) or copies of a power of attorney (if the application is filed by a patent attorney).
The application and the documents attached to it are submitted directly to the expert organization, sent by mail or to the company’s email address.
It is also necessary to pay for the renewal of the registration in accordance with the "Prices for work and services sold by the RSE" NIIP "of the Ministry of Justice of the Republic of Kazakhstan.
A fee for the Extension of the validity period of a trademark, collective trademark, well-known trademark, service mark registration and publication of information on the extension, with the exception of SMEs, is set at 97144.32 KZT from January 1, 2021.
